That's not an easy answer. Texas is a community property state. The presumption is that all property is community property and therefore the spouse takes all. But-that's just a presumption and can be overcome. Also, community property does not include property received by gift or inheritance or property owned before marriage. Normally yes, but that would not prevent another family member from contesting all or part of the estate. You are much safer having a will.
