Is there a clause in INS law which says if a spouse is incarcerated they do not have to attend INS hearings?

I want to know if there are loopholes for Illegals trying to obtain their green cards. If there are clauses where one or the other ';spouse'; does not have to be present at hearings.Is there a clause in INS law which says if a spouse is incarcerated they do not have to attend INS hearings?
