How long will it takes if a permanent resident or US citizen spouse files I-130 for his/her spouse? My cousin is a permanent resident and his wife is in F-1 visa. He has to wait 2 more years to become a US citizen. Is it a good idea if he files I-130 for his wife while he is a permanent resident and since he only has two more years left to become a US citizen or should he wait until he become a US citizen to process I-130 for his wife?Petition for Alien Relative:Permanent resident filling for a spouse?
For a permanent resident petitioning a spouse the wait for a visa is between 5 and 6 years, except if the spouse is in Mexico where the wait is 8 years.
He can file now. When he has his citizenship he should notify USCIS and they will upgrade his petition from F2A to IR-1 and then there will be no wait.
