How to get a divorce if your spouse was deported?? Please help?

Ok so I was married to a guy who came to the united states illegally I wasn't aware of it until after we were married So he had gotten in to some trouble an was deported We were split up for over a year before he was deported but now I don't know how to refile for a divorce because he's not here to sign paperwork An we have 3kids together that i need to get full custody of ..... I've moved on since then but i really need to get a divorceHow to get a divorce if your spouse was deported?? Please help?
Some states allow a default divorce where the spouse's signature is not required to get it finalized. This may be the case with you. Since he's not a legal citizen of the US, and he's no longer in the US it would be hard to get him to sign the papers, or for him to contest the divorce.


I would file divorce papers and note his illegal status to the clerk. They may be able to tell you if there are any special provisions for your situation.

it depends on which state you live, but is of common sense , you have to do a summons and notify him through an Ad in the newspaper , there,s usually 30 days to answer this, and if not the trial continues.


Courts have profesionals to attend these type of questions. The difficult part is how can you pressure somebody to pay, when he lives abroad?

Check with INS, I believe that if your ex was deported as undesirable then you can file for dissolution in absentia, you don't need his signature on the papers. You may even be able to have the marriage annulled since he didn't legally have the standing to marry you here.
wow, im sorry, thats bad, i think though even if he was deported, he's not present and illegal so you should be able to do it without him being there, good luck and i would recomend contacting a lawyer for a free consultation.
there are ways of getting a divorce without one or the other being present. i believe you can claim abandonment or something to that effect. your first step to getting any of this done is talking to a lawyer though. good luck.
If you have an address of Hubby's location your lawyer can send him the papers to sign and Hubby can mail back to lawyers office.. NOw if he contest it your lawyer will tell you what to do onthat part.
maybe you should first get him his visa and passport so he can come back to the states, then take him to a lawyer and get divorced.
